First round of Kavanaugh's White House documents released

Source: The Hill

BY JORDAIN CARNEY - 08/09/18 01:47 PM EDT

The Senate Judiciary Committee on Thursday publicly released its first tranche of documents from Brett Kavanaugh's work in the George W. Bush White House.

The batch being released, totaling more than 5,700 pages, is part of more than 125,000 pages given to the committee last week by the George W. Bush Presidential Library. The office of Judiciary Committee Chairman Chuck Grassley (R-Iowa) said they expect more of the tranche to be cleared for public release over the next "several days."

William Burck, a lawyer for Bush’s legal team, noted in a letter to Grassley that due to "constraints" on National Archives staff, the legal team was in the process of determining which documents do not include privileged information and can be publicly released.

"In light of the constraints on NARA’s resources, and in the interest of expediting appropriate access to President Bush’s presidential records in furtherance of education and research about the Bush Administration, we are producing to the Committee on a rolling basis commencing today publicly releasable versions of documents that, in our view, do not contain information covered by a Presidential Records Act exemption or applicable privilege," Burck wrote in an Aug. 8 letter to Grassley.

Permit approved for 'Unite the Right' DC rally

Source: The Hill

BY JESUS RODRIGUEZ - 08/09/18 01:42 PM EDT

The National Park Service (NPS) has issued the official permits for the white nationalist rally and a counterprotest that will take place in Washington, D.C. this weekend.

"Permits were issued this morning for Jason Kessler and ANSWER Coalition and will be posted on the National Park Service Freedom of Information Act website as soon as the FOIA officer has reviewed them and applied any necessary redactions," said Mike Litterst, the chief of communications for the National Park Service, in a release Thursday.

The agency initially approved an application submitted by Jason Kessler, one of the organizers of last year’s “Unite The Right” rally in Charlottesville, Va., but had not issued an official permit because it was finalizing a security plan with law enforcement agencies.

The NPS has also issued permits for two counter protests, including one organized by a coalition of 18 anti-fascist, anti-racist and feminist groups. Another permit was issued Wednesday for a rally being organized by ANSWER coalition, a left-wing group.

By Josh Marshall | August 8, 2018 12:48 pm

I don’t want to be mean. But Dana Bash just said Donald Trump got elected because of outrage over sleazy Reps like Chris Collins, the first member of Congress to endorse Donald Trump.

Jeff Sessions wants to keep working with this hate group, so he told them they aren't a hate group

The Alliance Defending Freedom is totally a hate group.

ZACK FORD AUG 9, 2018, 9:53 AM

A week after announcing a mysterious new “religious liberty task force,” Attorney General Jeff Sessions once again addressed the Alliance Defending Freedom (ADF) on Wednesday. He assured them that he does not believe they are a hate group for constantly advocating for discrimination against LGBTQ people, and then claimed that his Department of Justice does not “partner with any groups that discriminate.”

Sessions previously spoke to ADF last June, and his at-the-time secret address caused quite a backlash as many in the media pointed out that the Southern Poverty Law Center (SPLC) has identified ADF as an anti-LGBTQ hate group. His remarks were later made public, and ADF took a conservative media tour to claim that they were a victim of this false accusation.

This time, Sessions addressed the controversy head on. After mentioning “the ordeal faced bravely by Jack Phillips,” the baker ADF represented in Supreme Court who blatantly discriminated against a same-sex couple, Sessions told the group that people of faith are facing “a bigoted ideology which is founded on animus towards people of faith.”

“You’ll notice that they don’t rely on the facts,” he said. “They don’t make better arguments. They don’t propose higher ideals. No, they just call people names—like ‘hate group.'”

The completely bonkers reason white supremacists are allowed to rally with guns in Charlottesville

No, the Second Amendment does not protect them.

IAN MILLHISER AUG 9, 2018, 12:31 PM

This weekend marks the one year anniversary of the “Unite the Right” rally, a white supremacist march in Charlottesville, Virginia that culminated in the death of counter-protester Heather Heyer.

In anticipation of the possibility that racist groups will commit similarly violent acts this weekend, Virginia Gov. Ralph Northam (D) and the city of Charlottesville itself have both declared states of emergency. Charlottesville officials in particular have “announced a security perimeter downtown that will include blocked streets, limited parking and pedestrian checkpoints,” beginning at 6 pm Friday. The city has also provided a long list of items that will be banned from this secure area, as they could potentially be used as weapons.

Interim City Manager Mike Murphy has prohibited the following items within the downtown security area: BB guns, pellet guns, air rifles or pistols, paintball guns, nunchucks, Tasers or other stun guns, heavy-gauge metal chains, lengths of lumber or wood, poles, bricks, rocks, metal beverage or food cans or containers, glass bottles, axes, axe handles, hatchets, ice picks, acidic or caustic materials, hazardous or flammable or combustible liquids, skateboards, swords, knives, daggers, razor blades or other sharp items, metal pipes, pepper or bear spray or Mace, aerosol sprays, catapults, wrist rockets, bats, sticks, clubs, drones, explosives, fireworks, open fire or open flames and any other item considered to be an “implement of riot.”

Yet, as Charlottesville’s Daily Progress reports, this list does not include one very notable weapon. Nunchucks, swords, paintball guns, and “lengths of lumber” may be banned, but real guns are not. “[Handguns] are not on that list,” Charlottesville Police Chief RaShall Brackney told the Daily Progress. “We have to honor your Second Amendment rights.”

Local police are, indeed, bound by the Second Amendment. But as it happens, there is no Second Amendment right permitting a violent white supremacist to bring a gun to the site of a deadly rally on that rally’s anniversary during a lawfully designated state of emergency. It is possible that Virginia state law restricts Charlottesville’s ability to keep guns away from the secured area, but that’s the fault of the state legislature — and it is also something the state legislature could have fixed. The Second Amendment does not say what Brackney claims that it says.

Harris Faulkner, After Louie Gohmert Says A Bunch of Wacko Nonsense About Mueller:

‘You’re An Excellent Lawyer!’

by Ken Meyer | Aug 8th, 2018, 3:55 pm

Fox News’ Harris Faulkner went out of her way to offer some praise to Louie Gohmert (R-TX) today when she interviewed him on Robert Mueller‘s requests to speak with Donald Trump.

The congressman went all out Wednesday when he demanded an investigation into the special counsel because it’s so supposedly obvious Mueller’s dead-set on ruining Trump and throw the upcoming midterm elections into chaos. Gohmert went off on this nonsensical-conspiracy raving for quite a while, but rather than ask questions or push back, Faulkner simply observed “you always manage to break it down to some new category” with his demand of turning the tables on Mueller.

“You say he wouldn’t care about politics anyway,” said Faulkner. “Lay conditions such that he wouldn’t accept. Wouldn’t he just slap the president’s team with a subpoena and would that be better or worse?”

Gohmert answered yes, and when he began talking about how he “used to be a good lawyer,” that’s when Faulkner said this:

Law Prof Declares 'Second-Rate Intellect' Sonia Sotomayor Only on Supreme Court for Her 'Latinaness'

by Ronn Blitzer | 3:15 pm, August 8th, 2018

University of Chicago Law Professor M. Todd Henderson recently got rid of Twitter for at least the second time this year after drawing backlash from inflammatory remarks. This time around, Henderson bashed Supreme Court Justice Sonia Sotomayor, insulting her intelligence and alleging that she only got her job because of her ethnicity.

While Henderson’s tweet–and account–are no more, a screenshot captured it saying, “I’m old enough to remember when a second-class intellect like Sotomayor got onto the Court because her Latinaness gave her insight into her soul.”

Of course, that “second-class intellect” graduated from Yale Law School, and taught at NYU and Columbia Law Schools, and has served on the federal bench since 1992. In 2009, she took her seat on the High Court.

Needless to say, this didn’t go over very well, and after getting some less than supportive responses, Professor Henderson deactivated his Twitter account.
