Federal judges

Federal judges can issue arrest warrants when probable cause exists to believe that an individual has committed a crime. There have been plenty of crimes with more than probable cause.

Why haven't we seen any arrest warrants?

International Criminal Courts

I recently posted a note about the ICC in hopes that this would be a means of prosecuting the convicted felon for his presidential crimes.

Here is more information on how the ICC operates. It is not a simple process. One problem is, the US is not a member of the ICC. However, other countries are, and if they were so inclined, could initiate a case.

The prosecution process can be initiated in three main ways:

State Party Referral (possibly but not likely in this case)

A country that is a member of the ICC (a State Party) can refer a situation involving alleged crimes (e.g., war crimes, crimes against humanity, genocide, aggression) committed in the territory of a member state or by its nationals.

Prosecutor’s Own Initiative (more likely)

The ICC Prosecutor can initiate an investigation on their own, but this requires:

- Authorization from a Pre-Trial Chamber (a panel of ICC judges)

- A reasonable basis to believe a crime within the Court’s jurisdiction has been committed.

UN Security Council Referral (this is very unlikely given the US and Russia are permanent members)

The UN Security Council can refer a situation to the ICC, even if it involves a country that is not a State Party (e.g., Sudan, Libya). This is how the ICC gained jurisdiction over certain non-member states.

From a person who is familiar with the ICC:

Although the US isn’t a member of the ICC, El Salvador still is. As was shown with alleged Israeli war crimes in Palestine, the ICC *could* claim jurisdiction over illegal actions committed on behalf of the US government *in* El Salvador, and issue arrest warrants for Trump and Rubio.

Worldwide support

As a result of the debacle in the oval office between a president and a convicted rapist, genuine American now have global support in their efforts to defeat this administration’s agenda.

Hopefully, this will encourage the Democratic legislators to ditch their war of useless words and take more decisive action. Even though the GOP might ignore the courts, more legal action against Trump, Musk, et al would be more resolute than dialog.

The new CEO of Starbucks is getting about $113 million dollars annually in various forms of compensation. This is about 7,900 times the average salary of Starbuck's workers. How do you feel about this??
